Three Charged with Capital Murder in Newport Beach Fashion Island Robbery-Slaying

NEWPORT BEACH, CA — The Orange County District Attorney's Office has filed capital murder charges against three men in connection with the tragic death of 68-year-old Patricia McKay, a tourist from New Zealand who was killed during a robbery attempt at the Fashion Island mall.

District Attorney Todd Spitzer announced that the suspects are eligible for the death penalty due to the special circumstance of murder committed during an attempted robbery. The defendants have been identified as Leroyernest Nelson McCrary, Jaden Cunningham, and Malachi Darnell.

Tragic Incident Unfolds

According to prosecutors, the incident occurred as Patricia McKay and her husband Doug were waiting outside a department store. The suspects allegedly accosted the couple in an attempt to steal their belongings, including a luxury watch. During the struggle, McKay was knocked to the ground and run over by a Toyota Camry driven by one of the suspects as they fled the scene.

DA Todd Spitzer expressed deep condolences to the victim's family and condemned the suspects' actions:

"Our hearts break for the McKay family and the entire nation of New Zealand. This was a cold, calculated crime carried out by individuals who showed absolute disregard for human life. We will prosecute them to the fullest extent of the law."

In addition to capital murder, the suspects are charged with attempted second-degree robbery and police evasion. The case has put a national spotlight on retail crime and public safety in affluent Southern California shopping destinations.
